NSR Menu

In 2004, EPA substantially altered the Clean Air Act program for New Source Review (NSR). Because many state and local air pollution control agencies believe the revised rules could diminish air quality protections and undermine the achievement and maintenance of our nation’s clean air and public health goals, many of them expressed intent to adopt rules that differ from the federal rule, or to retain all or part of their existing rules. (They are not required to adopt the new rules published by EPA, as long as their state or local programs are at least as stringent as the federal program.)

STAPPA and ALAPCO developed an NSR Menu of Options that states can use when they revise their State Implementation Plans (SIPs) to adopt the federal NSR rules promulgated December 31, 2002. For each of the main elements of the federal rules, STAPPA and ALAPCO provide alternative. Regulatory Language is presented in a side-by-side format, with the federal rule language on the left side and the corresponding Menu choice provisions on the right, also in regulatory language. The Menu includes multiple options for many of the revised program elements, presenting a range of solutions from which permitting agencies may design the most effective program for their needs.
